I represent a home health company. Their director contacted me yesterday with a "NOTICE OF GARNISHMENT" marked "URGENT" and "Immediate Response Required," for a debt owed by one of their employees. After reviewing the supposed "Garnishment Order" I noticed that the document was generated by an out of state collection company. No court or cause number was listed, and a quick check of Odyssey showed no case in the State of Indiana against the employee / defendant.
I immediately contacted my client and told them not to pay the "garnishment" or to contact the collection company. This is obviously an unfair debt collection practice that my client and her employee have had deal with, at some expense.
My question is, whether my client should contact the attorney general or other state agency. My client is not a consumer by any means, so I am not sure if there is a civil remedy worth pursuing.
Does anyone have any ideas?
